Terms of Service

Thanks for choosing BrainChat AI. These terms form an agreement between you and BrainChat AI ("BrainChat AI", "we", "us"), the service operated by Yousef Alkhub. No registered company status is represented here. When you create an account or keep using BrainChat, you agree to these terms. Our Privacy Notice explains how we handle your data.

Ownership: BrainChat AI and brainchatai.com are 100% solely owned by its founder and creator, Yousef Alkhub.

1. Your account

• You must be at least 13 and old enough where you live to accept these terms; if you're under 18, a parent or guardian must agree too.
• If you use BrainChat for an organization, you confirm you're allowed to accept these terms on its behalf.
• Give us accurate information and keep it up to date. Keep your password private — you're responsible for everything done through your account.

2. What BrainChat provides

BrainChat AI is an AI assistant offering chat, web search, file and image understanding, image creation, voice typing and conversational voice on phones, Projects, Library and Scheduled tasks, under a Free plan and paid plans. We give you a limited, personal, non-exclusive and non-transferable right to use BrainChat within your plan. We keep improving BrainChat, so features may change, and we can't promise it will always be available or error-free.

3. Using BrainChat responsibly

You agree not to:

• use BrainChat for anything illegal, fraudulent or harmful, or to send spam;
• create or share illegal content, sexual content involving minors, deceptive deepfakes, hate speech, harassment or malware;
• infringe or misuse anyone's intellectual property, privacy or other rights;
• try to jailbreak, manipulate or bypass BrainChat's safety measures, usage limits or other technical restrictions;
• interfere with BrainChat's security or systems, or probe, scan, scrape or overload them;
• reverse engineer, copy, resell or redistribute the service, or use outputs to build a competing model;
• present AI output as human-made when that would mislead people.

Adult and sexually explicit content — zero tolerance. BrainChat AI respects the laws, public decency standards and values of the State of Qatar. Any request to create, describe or obtain pornographic, nude, sexually explicit or other 18+ material, in text or images, is strictly prohibited. Any such attempt may result in immediate termination of your account, without prior warning and without refund, to the extent permitted by applicable law.

Graphic gore, extreme violence and self-harm — zero tolerance. Any request to create, describe or obtain graphic gore, mutilation, dismemberment, torture, extreme or glorified violence, violent hateful imagery, or instructions or encouragement for self-harm or suicide, in text or images, is strictly prohibited. Non-graphic creative content such as mild spooky or fantasy art is allowed. Any deliberate attempt may result in immediate termination of your account, without prior warning and without refund, to the extent permitted by applicable law. If you are struggling, please contact local emergency services or a trusted person.

Identity documents and forgery. You must not create, forge, alter, counterfeit or simulate official identification or credentials, including national IDs, QIDs, passports, driver's licences, visas, residence permits, official seals or financial instruments. Legitimate help such as reading, redacting or renewing your own documents is allowed. We apply graduated enforcement: an isolated or accidental request is simply declined; repeated attempts lead to a formal warning and may restrict features; deliberate, persistent or fraudulent attempts may lead to suspension or termination without refund, to the extent permitted by applicable law, and may be reported to the competent authorities.

Your responsibility. BrainChat AI operates as an automated technical service. You are solely responsible for your prompts, uploads and how you use outputs, and you agree to indemnify and hold harmless BrainChat AI and its owner, Yousef Alkhub, against claims, fines, inquiries or costs arising from your breach of these terms or of applicable law.

Fair use, rate limits and cooldowns. Every plan, including paid plans, includes daily allowances and short-term rate limits that keep BrainChat fast and fair for everyone. If you send requests very quickly or in large bursts, BrainChat may pause new requests temporarily (a cooldown) or answer with a lighter model for a while. A cooldown is a temporary protective pause, not a cancellation of your plan or your daily allowance; you can continue once it ends, and daily allowances reset each day. These limits are part of the service you subscribe to and are not by themselves a reason for a refund, but they do not limit any rights you have under applicable law.

4. Your content

Input is what you give BrainChat (prompts, files, images, audio) and output is what BrainChat gives back. You keep your rights to your input and, as between you and us, you own the output, as far as the law allows. You confirm you have the rights needed for anything you upload. You give us a limited license to store and process your content only to provide and protect the service.

Because AI can produce similar answers for different people, other users may receive output like yours.

5. Accuracy of AI output

AI is powerful but not perfect. Output can be wrong, incomplete or out of date, even when it sounds confident. You're responsible for how you use it and for checking anything important. BrainChat is not a substitute for a doctor, lawyer, financial adviser or other professional, and shouldn't be used for regulated decisions without qualified human review.

6. Content moderation and copyright complaints

Automated safety checks may decline requests. We may investigate reports, remove or restrict reported content where authorized, and limit or suspend accounts that break these terms. If you believe something on BrainChat infringes your rights, tell us at BrainChat.support@gmail.com; we'll review it and take it down where appropriate. Accounts that repeatedly infringe may be closed.

7. Our property

BrainChat AI owns the service and all related intellectual property, including the software, design, documentation and the BrainChat name and logo. Nothing in these terms transfers these rights to you.

8. Plans, payments and cancellation

Plan features are listed on Pricing; current daily allowances and usage guidance are in Help. Attempts may count once processing starts, including failed or canceled requests. Paid plans are billed monthly or yearly and renew automatically until you cancel. You can cancel at any time from your billing page; you'll keep access until the end of the period you've paid for.

Review the payment service, total, renewal interval and applicable terms shown at checkout before confirming. Opening checkout does not complete a purchase. Payments are non-refundable once successfully processed, except where applicable law requires otherwise; see our Refund & Cancellation Policy.

9. Suspension and ending your account

You can stop using BrainChat at any time. Account deletion is available in Settings once paid access expires and pending billing operations finish; cancel renewal first. We may suspend or close your access if you seriously or repeatedly break these terms, don't pay, or create a security, fraud or legal risk. When access ends, you can ask us to export or delete your data at BrainChat.support@gmail.com.

10. Disclaimers and limits on liability

To the fullest extent the law allows, BrainChat is provided "as is", without implied warranties such as merchantability or fitness for a particular purpose. We aren't liable for indirect, incidental, special or consequential losses, including lost profits, data or goodwill. Our total liability for any claim is limited to what you paid us in the 12 months before it. Nothing here limits liability for fraud, death or personal injury, or anything else that the law doesn't allow us to limit.

11. Indemnity

If someone brings a claim against us because of your content, your unlawful use of BrainChat or your breach of these terms, you agree to cover the reasonable costs that result, where the law allows.

12. General terms

• Changes: we may update these terms; the date at the top shows the latest version, and we'll notify you of major changes. Continuing to use BrainChat means you accept them.
• Transfer: you can't transfer this agreement without our permission; we may transfer it as part of a merger or acquisition.
• Events beyond our control: we aren't responsible for delays or failures caused by events we can't reasonably control.
• Disputes: please contact us first — most issues can be solved quickly. These terms are governed by the laws of the State of Qatar, and any remaining dispute will be handled by the competent courts of the State of Qatar, without prejudice to non-waivable consumer protections in your home country.
• Whole agreement: if part of these terms can't be enforced, the rest still applies.
