Privacy Notice

Last updated October 2026

Your trust matters to us. This notice describes how BrainChat AI ("BrainChat AI", "we", "us") handles personal data when you visit our website or use the BrainChat AI assistant, including chat, voice, image, file, Projects, Library and Scheduled features.

The short version

  • We use your data to run BrainChat, keep it safe and make it better. We never sell it.
  • Your chats are not public and are scoped to your account. You can export or delete chat history in Settings.
  • Payment details are handled by the payment service identified at checkout.
  • You can ask us to access, correct or delete your data whenever you like.
  • Please don't submit highly sensitive information unless it is necessary — AI, search and hosting services process what you send.
  • We do not claim certification or guaranteed compliance with any specific law. Exact provider and backup retention periods are not specified; contact support for details.

1. Who we are

BrainChat AI is the data controller responsible for your personal data. That means we decide why and how it is used. Questions about this notice can be sent to us at BrainChat.support@gmail.com.

2. Information we collect

Information you give us

  • Account details — name, email address and sign-in credentials.
  • Your content — prompts, messages, uploaded files and images, generated images, project instructions, scheduled task prompts and voice audio while a call is active.
  • Messages to us — what you send when you ask for help or give feedback.

Information collected automatically

  • Usage data — your plan, how many messages, images and uploads you use, and which features you open.
  • Device and connection data — browser and device type, IP address, approximate region and time zone (used, for example, to answer "weather near me").
  • Cookies and local storage — see section 9.

3. How we use it, and our legal basis

  • Running the service — creating your account, generating replies, saving your history, running your scheduled tasks and applying plan limits. Basis: performance of our contract with you.
  • Safety and security — preventing fraud, abuse and unauthorized access, and enforcing our terms. Basis: legitimate interests.
  • Improving BrainChat — understanding overall usage and fixing problems. Basis: legitimate interests.
  • Support and service messages — answering you and telling you about important changes. Basis: contract and legitimate interests.
  • Legal duties — keeping required records and responding to lawful requests. Basis: legal obligation.
  • Optional features — such as microphone access for voice. Basis: your consent, which you can withdraw at any time.

4. How your conversations are processed

To answer you, your message, recent context from the chat and any attachments are sent to the AI model providers that power BrainChat. When BrainChat searches the web, only the search terms are sent to the search provider. App diagnostics record error codes and connection states rather than conversation content. Hosting and AI providers have their own operational logs and retention practices; these are not established by this notice. Voice transcript fragments are saved as messages in your conversation when the session ends. Web searches can contain personal details if included in a search query, so avoid sharing unnecessary sensitive information.

5. Who we share it with

  • Service providers — companies that host, store, secure and process data for us (cloud hosting, database, authentication, AI models and web search), only under our instructions.
  • Payment services — the service identified at checkout processes payment details under its own terms and privacy statement. Contact support with your receipt reference if you need clarification.
  • Professional advisers — lawyers, accountants and auditors when needed.
  • Authorities — when the law requires it or to protect people's rights and safety.
  • A future owner — if BrainChat AI is involved in a merger or acquisition, subject to this notice.

We do not sell your personal data or share it for advertising.

6. International transfers

Our providers may process data in countries other than yours. Applicable transfer requirements and provider agreements need to be assessed for the locations served. We do not claim that a particular transfer safeguard or legal certification has been verified.

7. How long we keep it

We keep your account and chat history while your account is open. Chats you delete are removed from your account straight away. Usage and security records are kept only as long as they are needed for their purpose. Exact security, billing, backup and provider retention periods require confirmation. Delete your account in Settings → Danger zone; paid access must expire and pending billing operations must finish first. Cancelling renewal does not itself delete your account. You can also contact BrainChat.support@gmail.com about data requests.

8. Your rights and choices

Depending on where you live, you may have the right to:

  • access the personal data we hold about you and get a copy of it (you can also export your chats in Settings);
  • correct data that is wrong, or delete it;
  • restrict or object to certain processing, including processing based on legitimate interests;
  • receive your data in a portable format;
  • withdraw consent at any time, without affecting earlier processing;
  • complain to your local data protection authority.

Contact us at BrainChat.support@gmail.com to use these rights. Applicable response deadlines depend on your jurisdiction; no fixed support response time is promised here.

9. Cookies

Sign-in uses cookies or local storage. Device-local preferences remember theme, accent, voice and answer style. Clearing browser storage can sign you out and reset these preferences. Hosting may also collect visit analytics; its storage and consent requirements need review before optional tracking or advertising is enabled. This notice does not certify that every third-party cookie is essential.

10. Security

We protect your data with technical and organizational measures, including encryption in transit, strict access controls and account-level isolation. Customer-facing account tools do not provide routine founder/admin browsing of private chats or files. Providers process content to deliver the service, and privileged infrastructure operations may be necessary for security or legal duties. No system is perfectly secure, so please use a strong password and keep it private.

11. Children

BrainChat isn't meant for children under 13. If you believe a child has given us personal data, email BrainChat.support@gmail.com and we'll delete it.

12. Changes to this notice

If we update this notice, we'll change the date at the top, and for important changes we'll let you know in the app.
